Elements “Take Sides On” Vote & Win Sweepstakes

1. SPONSOR: Snapple Beverage Corp., 900 King Street., Rye Brook, NY 10573

2. ADMINISTRATOR: Dott-Communications, LLC, an independent judging organization whose decisions are final and binding in respect to all matters relating to the Sweepstakes.

3. ELIGIBILITY: This Sweepstakes is open to legal residents of the 50 United States and the District of Columbia ("Territory"), who are 18 years or older as of the entry date. Employees of Sponsor or Administrator; their respective parent, subsidiary or affiliated companies; or the advertising, promotional or fulfillment agencies of any of them; (individually and collectively, "Entities") or members of their immediate families or same households are not eligible to enter or win.

4. ENTRY: This Sweepstakes may only be entered by Internet during the period commencing at 12:01:00 A.M., March 1, 2006, and ending at 11:59:59 P.M., March 31, 2006 ("Term"). For purposes of these Official Rules ("Rules"), all times are Eastern Time. You may only enter by visiting www.elementsbev.com and answering any one of the three monthly “Take Sides On” poll questions and by providing the requested information through the "Take Sides On" link. Normal Internet access and usage charges imposed by your on-line service will apply. You will receive an entry regardless of your answer to the applicable question.

5. LIMITATIONS: Entries for the Prize Drawing must be received by the date and time stipulated in the Prize Drawing Schedule detailed in the chart below. Limit one entry per e-mail address (regardless of whether one person has more than one e-mail address or more than one person uses the same e-mail address). In event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered. Entries by any method other than method set forth above are void. Any use of automated or programmed methods of effecting entry on-line is prohibited. The Entities are not responsible for entries from persons residing, or physically located, outside the Territory; entries that are inaccurate, incomplete, garbled, tampered with, lost, interrupted, deleted, defective, stolen, destroyed, altered, given unauthorized access to, misdirected, non-delivered, delayed, late or misrouted; inaccurate or incomplete capture online of Sweepstakes entry information (including the Official Entry Form); lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; or other errors of any kind, whether due to electronic, mechanical or human error or other causes; each of which potential entries will be disqualified. Void where prohibited by law and subject to all applicable federal, state and local laws and regulations.

6. PRIZES: ONE (1) TOTAL PRIZES: One (1) Elements MBS Mountain Board (approximate retail value ["ARV"]: $199.00 each). Total ARV of all prizes: $199.00. Limit one prize per person/family/household. Prizes are not redeemable for cash or transferable. No substitutions allowed except, at Sponsor's sole discretion, a prize of equal or greater value may be substituted. Taxes and other expenses, if any, not specified herein are the sole responsibility of the winner. All prizes will be awarded provided a sufficient number of eligible entries are received.

7. PROCEDURES: One potential winners will be chosen in each of the Monthly Prize Drawings from among all eligible entries received by the end date of the applicable Monthly Prize Drawing (as specified in the chart below) under the supervision of the Administrator. Non-winning entries from Prize Drawing will not “roll-over” into subsequent Prize Drawings. Odds of winning depend on the total number of eligible entries received by Prize Drawing end date.

8. NOTIFICATION: : Potential winners will be notified by e-mail following the drawing date of the applicable Prize Drawing. Winners will be required to complete and return a Liability Release Form within 10 days of notification. Disqualification and the selection of an alternate winner will result from any of the following: (1) failure of a potential winner to respond to e-mail notification within ten (10) days from the date of transmission; (2) the return of potential winner's e-mail notification as undeliverable after three [3] attempts; (3) the return of any other notification or prize as undeliverable; (4) potential winner’s failure to complete the Liability Release Form within 10 days of notification; (5) potential winner's failure to claim a prize within ten [10] days after being sent; or (6) any other non-compliance with Rules.

9. CONDITIONS: Each entrant by entering this Sweepstakes agrees that: (1) he/she will abide by and be bound by the Rules and Sponsor’s and Administrator's decisions; (2) the entry becomes solely the Sponsor's property and will not be returned or acknowledged; (3) none of the Entities, nor any of their officers, shareholders, directors, employees, agents or representatives are responsible for claims, injuries, losses or damages of any kind resulting from Sweepstakes participation; the awarding, acceptance, use, misuse, possession, loss or misdirection of any prize (including any use of the Elements MBS Mountainboard); participation in any prize related activity or from computer downloading any Sweepstakes information; (4) the prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose); (5) winner's acceptance of a prize constitutes the grant of an unconditional right to use winner's name, address (city and state only), voice, likeness, photograph, biographical and prize information and/or statements about the promotion for any publicity, advertising and promotional purposes in all media at the discretion of the Sponsor without additional compensation, except where prohibited by law; (6) In the event viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control corrupt or impair the administration, security, fairness or proper play of this Sweepstakes, such that it cannot be conducted as originally planned, the Sponsor has the right to cancel, terminate or suspend the Sweepstakes and in such event, at its discretion to select winners by random drawing from among all eligible, non-suspect entries received for the Monthly Prize Drawing at issue up to such time of cancellation, termination or suspension; (7) any portion of any prize not accepted by any winner will be forfeited; and (8) Sponsor is not responsible for any inability of any winner to accept any prize for any reason.

10. WINNERS LIST/RULES: For an up to date list of Winners, send a self-addressed, stamped #10 envelope to: Elements “Take Sides” Sweepstakes, 900 King Street, Rye Brook, NY 10573 by August 1, 2006. VT residents may omit return postage on rules requests.
